Terms & Conditions
- Information on how to participate in the Lexmark Cash Back Promotion forms part of these Terms and Conditions. Claims that do not comply with these Conditions of Entry are ineligible. Internet access and a valid email account are required to redeem a cash back. By redeeming a cash back, participants agree to be bound by these Terms and Conditions .
- Lexmark Cash Back is open to all residents of Australia. Employees of the Promoter and their immediate families and the affiliated companies and agencies and their respective employees are ineligible to claim a cash back.
- "Participant" refers to residents of Australia who purchase a qualifying product from a participating outlet during the promotional period and is the end user of that Product. "Product" refers to any Lexmark product model mentioned within the terms and conditions.
- "Promoter" refers to Lexmark International (Australia) Pty Limited A.B.N. 86 050 148 466 of 13b Narabang Way Belrose, NSW, 2085.
- The following Lexmark codes originate from the Promoter and are classified as "Lexmark Printers" X1270 All-In-One Printer, X2530 All-In-One Printer, X2550 All-In-One Printer, X5450 All-In-One Printer, X5470 All-In-One Printer, X4530 All-In-One Printer, X4550 All-In-One Printer, X4850 All-In-One Printer, and X6570 All-In-One Printer.
- To be eligible for this promotion, the participant must purchase and redeem within the promotional period the following eligible Lexmark Printers to obtain the stated cash back (a) $20 cash back claimable on purchase of X1270, X2530 and X2550 printers (b) $40 cash back claimable on X5450 and X5470 printers (c) $50 cash back claimable on X4530 and X4550 printers, and (d) $75 cash back claimable on X4850 and X6570 printers.
- Promotion available while stocks last of selected printers pertaining to this promotion. Claims will not be accepted on back-ordered products or on lay-by’s until payment is complete.
- Entries into the promotion are valid only for Product purchased in Australia in participating outlets between November 1st 2007 and 31st January 2008. Final claims must be postage stamped prior to 15th February 2008. Participant(s) will forfeit claims not made by this date.
- Exceptions to the above dates due to catalogues and special promotions will be for; (a) Harvey Norman customers who can claim purchases from the 28th October, 2007 to 31st January 2008. Final claims must be postage stamped prior to 29th February 2008. (b) Australia Post and Woolworths/ Safeway customers who can claim purchases from November 1st 2007 to 29th February, 2008. Final claims must be postage stamped prior to 14th March, 2008.
- The Participant must visit www.lexmark.com.au/promotions, complete an official on-line claim form entering their details, associated survey questions and the serial number from their purchased product. The participant is then required to print the form (which will also be emailed to them for verification) and send to "Lexmark CASH BACK" promotion as per instructions on the promotion website.
- Participants must submit a legible photocopy of their Tax invoice (hand written Tax Invoices will not be accepted) with any claim as proof of each product purchased (delivery dockets are not accepted as proof of purchase) or claim will be rejected. Originals do not need to be sent. In addition the participant must cut out and attach the bar code of their product to their claim form to be verified and eligible.
- Multiple entries are accepted but limited to 3 entry redemption's for each individual / company participant. Each entry must include a serial number for each separate item purchased. Each product purchase can only be used once for entry. Claims will be deemed invalid if the same serial number is used on more than one entry.
- The participant will be responsible for all charges relating to the postage of their claim.
- No responsibility is accepted for late, lost or misdirected mail.
- The cash back funds will be issued by cheque to the Participant's company name as listed on the claim form or the Participant's name where a company name is not listed. Funds will be issued in Australian Dollars.
- Please allow approximately 75 days from the date that the claim is validated for processing.
- Participants must claim their cash back funds by banking their cheque within a period of 6 months following the issue date listed on the cheque.
- Once issued, cheques will not be reissued for any reason.
- The Promoter reserves the right to extend the closing date of the promotion at their discretion.
- Promotion not valid in conjunction with any other offer or promotional product bundle.
- The Promoter's decision on all matters pertaining to this Promotion is final and binding and no correspondence will be entered into, except as otherwise stated in these terms and conditions. No correspondence will be entered into after 6 weeks of closing date of promotion.
- Claims are not transferable or assignable.
- The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for a personal injury suffered or sustained, as a result of participation in this promotion, except for any liability which cannot be excluded by law.
- The Promoter will use the information contained in the claim form to contact Participants if it has any queries regarding claims, and to send fulfillment of cash back claim.
- The Promoter reserves the right to verify all entries. Entries are void if illegible, forged or tampered with in any way. No responsibility is accepted for late, lost or misdirected claims via the internet.
- To the extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any web site, or any unauthorised intervention, or any combination thereof, including injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition.
- If for any reason this cash back redemption is not capable of running as planned including; infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the promoter which corrupt or affect the administration security, fairness integrity or proper conduct of this redemption, the promoter reserves the right in it's reasonable discretion to disqualify any individual who tampers with the redemption process and to cancel, terminate, modify or suspend related redemption claims
- Unless otherwise notified by the Participant, in providing their personal details, each Participant agrees to the Promoter using their details for future marketing and publicity purposes, to the extent permitted by the law, and to the Promoter disclosing such information to third parties for this purpose. All personal details of Participants will be stored in a database at the office of the Promoter or its Agencies. The Promoter is committed to the protection of personal information. A request to access, update or correct any information should be directed to the Promoter.
